NOX PERFORMANCE TERMS & CONDITIONS 

By engaging with Nox Performance and availing our services, you automatically accept and consent to adhere to the terms and conditions detailed on our web page. It is crucial to familiarize yourself with these terms to ensure a smooth and satisfactory experience with us. You can find the comprehensive list of our terms and conditions as listed below.

Client Health and Declaration

  • When completing a booking or registration or purchasing an athlete program you are confirming that you are in good physical health to perform the trainings.

  • You will let Nox Performance know of any medical history that may affect your training.

  • Failure to do this will mean Nox Performance is not liable for any injuries that occurs during your involvement with Nox Performance.

1. Speed Clinics

1. SPEED CLINICS

1.1 Booking and Late Booking Fee:

  • Speed clinics must be booked at least 2 days prior to the session date.

  • If booked after the specified time frame, a 10% late booking fee will be added on top of the regular booking fee.

  • This late booking fee will be added to the overall payment invoice, and you will be notified via email or notification.     

1.2 Payment and Refunds:

  • No deposit is required, and one-off payments are non-refundable unless you need to cancel the session, or the services provided were inadequate.

  • Payments will be made through direct debit, unless discussed otherwise with Nox Performance.

1.3 Cancellations and Refunds:

  • Cancellations of a booking must be made at least 24 hours before the scheduled session to be eligible for a full refund.

  • If you cancel within the specified timeframe, you may credit the specific speed clinic to another date or request a refund.

  • No refund will be issued for cancellations made after the specified timeframe.

1.4 Weather-Dependent Training:

  • Speed clinics are conducted outdoors on a track, and training may be affected by weather conditions.

  • The Head trainer will inform you via email at least 24 hours before the speed session time and date if the training will proceed or be canceled due to weather conditions.

1.5 Professional Conduct:

  • Speed clinics are conducted in a group environment, and participants are expected to maintain a professional attitude and demeanor.

1.6 Arrival and Warm-up:

  • Participants must show up at least 10 minutes before the start time to allow for proper warm-up and to discuss the session with the trainer.

1.7 Liability for Injuries:

  • Any injuries or mishaps that occur during the speed clinics are not the responsibility or liability of the head trainer.

  • The head trainer may provide advice on injuries or medical issues, but they are not expected to fully help or provide medical expertise. It is best to seek specific help from a qualified professional.

1.8 Age Groups and Communication:

  • Speed clinics are split into three different age groups.

  • Any athlete younger than 18 years old must be booked in through a parent or guardian, and all communication will be made with the adults only.

1.9 Media and Marketing:

  • Photos and media may be taken during the speed clinics for marketing and educational purposes.

  • By confirming a booking, you agree to this, but Nox Performance will always advise or inform clients prior to uploading anything.

  • Nox Performance will notify clients during the time of media capturing.

2. INDIVIDUAL SESSIONS

2. Individual Sessions

2.1 Booking and Payment:

  • One-off individual sessions must be booked at least 3 days prior to the appointment date.

  • Payments will be made through direct debit, with no deposit required. The payment is non-refundable unless you need to cancel the session, or the services provided were inadequate.

2.2 Cancellations and Refunds:

  • Cancellations of a booking must be made at least 24 hours before the scheduled session for a full refund to be available.

  • If you cancel within the specified timeframe, you may either credit the specific speed clinic to another date or request a refund.

  • No refund will be issued for cancellations made after the specified timeframe.

2.3 Weather-Dependent Training:

  • Speed individual sessions will be conducted on an outside track, and training may be affected by weather conditions.

  • The head trainer will inform you at least 24 hours before the appointment date if training is canceled due to weather or unforeseen circumstances preventing training from happening.

2.4 Location for Speed Training:

  • Most, if not all, outside track training will take place at Lovelock Training Track in Mt Roskill, unless otherwise discussed with the head trainer.

  • If you request training at a location closer to you, you may need to pay for the head trainer's gas expenses. The price of gas can be discussed with the head trainer.

2.5 Strength and Conditioning Training:

  • Strength and Conditioning individual sessions may be conducted outdoors or in a gym facility, depending on weather and an agreement between you and the head trainer.

  • If training is conducted in a gym, you may need to pay for your entry into the gym, unless discussed prior with the head trainer.

2.6 Liability for Injuries:

  • Any injuries or mishaps that occur during these individual sessions are not the responsibility or liability of the head trainer.

  • The head trainer may provide advice on injuries or medical issues, but they are not expected to fully help or provide medical expertise. It is best to seek specific help from a qualified professional.

2.7 Arrival and Preparation:

  • Clients need to be at the training location at least 10 minutes before the scheduled training time to allow for adequate preparation, including warm-up and planning.

2.8 Participants Under 18:

  • Any athlete younger than 18 years old must be booked in through a parent or guardian.

  • All communication regarding the training will be made with the adults only.

3. SPEED PROGRAM

3. Speed Program

3.1 Program Description:

  • The 4-week speed athlete program offered by Nox Performance is specifically designed for speed and running training on a track or field.

  • Please note that the training sessions are weather-dependent, and if weather conditions are not suitable for training, the session will be postponed to a later date. The program duration will be extended to ensure you receive the full 4 weeks of training.

3.2 Trial Period and Cancellation:

  • The first 7 days of the 4-week program will serve as a trial period. During this time, you can evaluate whether you wish to continue with the training or cancel.

  • If you decide to cancel within the 7-day trial period, you will be eligible for a 70% refund of the full payment. The remaining 30% will be retained by Nox Performance to cover the training sessions that have already been conducted.

  • After the trial period, there will be a 2-day cooling off period to finalize your decision, and no cancellations will be accepted beyond this period.

3.3 Booking and Rescheduling:

  • Before purchasing the 4-week program, you must select the specific dates for all the training sessions within the program. The program includes one in-person training session per week.

  • You will use the 'Setmore' app to book your desired training dates from the available options.

  • If you need to reschedule a booked session, kindly inform Nox Performance at least 24 hours in advance, and an alternative time will be arranged.

3.4 Age Requirement:

  • Only individuals over the age of 18 years are eligible to purchase and participate in the 4-week program.

  • In the case of someone under 18 wishing to enrol, their parent or legal guardian must complete the purchase on their behalf and be aware of their participation.

3.5 Training Locations:

  • The majority of outside track training will take place at Lovelock Training Track in Mt Roskill.

  • If you wish to train at a different location, please discuss this with the head trainer.

  • In such cases, you will be responsible for covering the head trainer's travel expenses for reaching the alternate location. Travel expenses can be negotiated with the head trainer.

3.6 Liability and Injuries:

  • Nox Performance and the head trainer will not be held liable or responsible for any injuries or mishaps that may occur during the training sessions.

  • While the head trainer may provide advice on injuries or medical issues, they are not expected to offer complete medical assistance, and it is advisable to seek specialized help.

3.7 Timeliness:

  • Clients are required to be at the training location at least 10 minutes before the scheduled training time. This allows sufficient time for adequate preparation, including warm-ups and session planning.

4. STRENGTH & CONDITIONING

4. Strength and Conditioning Programs

4.1 Program Description:

  • Nox Performance offers strength and conditioning training programs that can be conducted outdoors or in a gym, depending on your selected weekly program and prior arrangements with Nox Performance.

  • If training is held in a gym, you may need to cover your entry fee unless agreed upon with the head trainer.

  • Training sessions are subject to weather conditions, and in case of unsuitable weather, sessions will be postponed to a later date, and the program end date will be extended accordingly.

4.2 Trial Period and Cancellation:

  • For the 4-week program, the first 7 days serve as a trial period, allowing you to decide whether to continue or cancel the training. After the trial period, there will be a 2-day cooling off period to finalize your decision.

  • For the 8-week program, the trial period is the first 10 days, followed by a 2-day cooling off period.

  • For the 12-week program, the trial period is the first 13 days, with a 2-day cooling off period.

  • If you choose to cancel within the given time period, you will receive a 70% refund of the full payment, and the remaining 30% will be retained by Nox Performance to cover the training already provided.

  • No refunds will be granted beyond the trial and cooling off periods.

4.3 Program Booking:

  • Before purchasing any program, you must choose the specific dates for all weeks of your selected program through the 'Setmore' app, which offers available training dates.

  • If you need to reschedule a session, please notify Nox Performance at least 24 hours in advance to arrange an alternative time.

4.4 Age Requirement:

  • Only individuals over the age of 18 are eligible to purchase and participate in the strength and conditioning programs. If someone under 18 wishes to enroll, their parents or legal guardians must complete the purchase and be aware of their participation.

4.5 Liability and Injuries:

  • Nox Performance and the head trainer are not liable or responsible for any injuries or mishaps that may occur during the training sessions.

  • While the head trainer may provide advice on injuries or medical matters, they are not expected to offer comprehensive medical assistance, and it is recommended to seek specialized help when necessary.

4.6 Timeliness:

  • Clients are required to arrive at the training location at least 10 minutes before the scheduled training time to allow for adequate preparation, including warm-up and session planning.

5. Hybrid Athlete programs

5. HYBRID PROGRAMS

5.1 Training Location:

  • The training sessions may be conducted outdoors or in a gym, depending on the weekly program chosen and prior arrangements made with Nox Performance.

  • If training is held in a gym, participants must pay for their entry, unless discussed with the head trainer in advance.

5.2 Weather Conditions:

  • In case of unsuitable weather conditions, the training session will be postponed to a later date. The end date of the strength and conditioning program will be extended to match the purchased weeks.

5.3 Trial Period and Cooling Off Period:

  • For a 4-week program, the first 7 days will serve as a trial period, during which participants can decide to continue with the training or cancel. A 2-day cooling off period will follow the initial 7 days to finalize the decision.

  • Similarly, for an 8-week program, the first 10 days will be a trial period with a 2-day cooling off period afterward.

  • For a 12-week program, the trial period will be the first 13 days, followed by a 2-day cooling off period.

5.4 Cancellation and Refunds:

  • If the program is cancelled within the given trial period, a refund of 70% of the full payment will be provided, while the remaining 30% will be retained by Nox Performance to cover the training conducted during that time.

  • No refunds will be issued if cancellation occurs after the specified trial period.

5.5 Booking and Rescheduling:

  • Participants should decide on their desired training dates before purchasing the program. Booking of training sessions will be done through the app 'Setmore.'

  • If rescheduling is necessary, participants must inform Nox Performance at least 24 hours in advance to arrange an alternative time.

5.6 Age Limit:

  • Only individuals aged 18 and above are eligible to purchase and participate in the program.

  • For individuals under 18, a parent or guardian must sign in on their behalf, and the parents must be aware of their intention to purchase and train.

5.7 Liability and Medical Assistance:

  • Nox Performance will not be held liable for any injuries or mishaps that occur during the training session's

  • While the head trainer may offer advice on such issues, participants should seek specific medical help if needed.

5.8 Timeliness:

  • Participants must arrive at the training location at least 10 minutes before the scheduled training time to allow for adequate preparation, including warm-up and planning.

6. SUMMER CLUSTER PROGRAM

6.1 Program Duration:

  •  The 'Summer Cluster Athlete Program' spans 8 weeks, including 2 weeks dedicated to pre-program testing and a final testing session at the end.

  • The first testing session is scheduled for 02/12/23. The specific time and location will be communicated by Nox Performance one week prior.

6.2 Cluster Assignment:

  • Athletes will be grouped into clusters of no more than 4 individuals. Clusters may be formed by Nox Performance or athletes can suggest another athlete for cluster assignment.

6.3 Testing Sessions:

  • All athletes must participate in the testing sessions at the beginning and end of the program. Testing dates and times will be communicated by Nox Performance.

6.4 Training Schedule:

  • The program includes 2 to 4 weekly training sessions: one in-person speed training conducted by Nox Performance and the rest of the training sessions are strength and conditioning based to be completed individually.

  • Nox Performance will provide detailed athlete programs after the initial testing, outlining strength and conditioning exercises for the duration of the 8 weeks.

  • Nox Performance will conduct an in-person training at the start of the program to explain and demonstrate the strength and conditioning exercises.

  • In-person speed training will be held every Saturday at Lovelock Track in Mt Roskill. Specific times will be confirmed by Nox Performance a week prior.

  • Times and locations of these speed training sessions can be adjustable if discussed with Nox Performance at least a week before each speed session and if the majority if not all the group members agree to this change. 

6.5 Weather Dependent Sessions:

  • In-person speed training is weather-dependent. If conditions are unsafe, sessions will be postponed, and alternative dates will be communicated.

6.6 Participant Responsibility:

  • Athletes are responsible for following the provided athlete program correctly.

  • Nox Performance is not liable for injuries sustained during the program.

  • Athletes must arrive 15 minutes before each session, ready to warm up, and dressed in appropriate training gear.

  • Athletes must conduct themselves professionally and respectfully towards Nox Performance and fellow athletes.

  • Any misconduct may result in removal from the program with no refunds.

6.7 Payment Options & Refund Policy:

  • Payment can be made upfront or through afterpay.

  • Alternative payment options can also be organised and discussed with Nox Performance.

  • Athletes have up to 2 weeks into the program to decide whether to continue or opt-out.

  • Opting out within the first 2 weeks will result in a partial refund for the remaining 6 weeks.

  • No refunds will be given for opt-outs or cancellations after the initial 2 weeks.

  • Refunds will be calculated by Nox Performance and transferred to a nominated account within 6 business days.
